These terms are between PhiriMasters ("we", "us"), who supply this software, and the business licensed to use it ("you"). They govern your use of the system.
They are not the terms between you and your own staff or customers. Those are set out separately in Arishyn Pharma (Pvt) Ltd's own terms.
You get a non-exclusive, non-transferable right to use the system for your own business for as long as your subscription is paid up. You may not resell it, rent it out, or run it for another business without our written agreement.
Each licence covers the branches and staff numbers agreed with you. If you grow beyond them, the price changes at your next renewal rather than the system cutting you off.
Everything you put into the system stays your data: your staff records, your stock, your sales, your payroll. We do not own it, we do not sell it, and we do not use it to train anything.
You can ask for a full export at any time, and we will give you one in a readable format. If you stop using the system, you can take your data with you.
We hold and process your data only to run the service for you, and only on your instructions. Where your data includes information about your staff or customers, you are the controller of it and we act on your behalf.
The system runs on a private server. Backups are taken nightly and kept encrypted. Access is limited to the people who need it to keep the service running.
We aim to keep the system available at all times and monitor it automatically. We do not promise it will never be unavailable: a server, a network or a power failure can interrupt it.
Support is provided during business hours. We will tell you in advance about planned work wherever we can, and we will not do it during your busiest hours if we can avoid it.
You agree not to attempt to break into the system, interfere with other users, or use it for anything unlawful. You are responsible for keeping your own passwords and PINs private, and for what is done by the people you give access to.
Either of us can end this agreement at the end of a subscription term by telling the other in writing. We may suspend the service where an account is significantly overdue, or where continued use would put other users or the law at risk. In either case you keep the right to an export of your data.
The system is a tool that helps you run your business. It does not replace your own checking of your figures, and we are not liable for business decisions taken from them.
To the extent the law allows, our total liability to you in any twelve month period is limited to the fees you paid us in that period. We are not liable for lost profit, lost business or indirect loss. Nothing here limits liability that cannot be limited by law.
We may update these terms. Where a change materially affects you we will tell you before it takes effect, and it will apply from your next renewal.
These terms are governed by the laws of Zimbabwe, and the courts of Zimbabwe have jurisdiction over any dispute arising from them.
